1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Divine Bluebird Transport ("we," "us" or "our"), concerning your access to and use of our services.

2. Transportation Services

All transportation services provided by Divine Bluebird Transport are subject to the terms and conditions set forth in the Bill of Lading and any applicable transportation contracts. In the event of a conflict, the specific contract or Bill of Lading shall prevail.

3. Cargo Liability

Our liability for loss or damage to cargo is limited as defined by applicable law and our standard insurance coverage. We are not liable for delay caused by acts of God, public enemies, authority of law, quarantine, riots, strikes, force majeure, or hazards or dangers incident to a state of war.

4. Payment Terms

Unless otherwise agreed in writing, standard payment terms for approved accounts are Net 30 days from the date of invoice. Late payments may be subject to interest charges as allowed by law.

5. Hazardous Materials

As stated in our operational guidelines, we do not transport hazardous materials (HAZMAT). Shippers attempting to tender undeclared hazardous materials will be liable for all resulting damages and expenses.

6. Governing Law

These Terms shall be governed by and defined following the laws of Ontario, Canada/USA. Divine Bluebird Transport and yourself irrevocably consent that the courts of Canada/USA shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
